Navon Finance LLC (“Company,” “we,” “our,” or “us”) values the privacy of individuals who use our website and related services (collectively, the “Services”). This Privacy Notice (the “Notice”) describes the information that we gather from visitors, users, and others who access or use the Services (“Users” or “you”), how we use and disclose such information, and the steps we take to protect such information. This Privacy Notice describes only privacy practices of the Company and does not cover the practices of other companies.

  • Information We Collect

Depending on how you use the Services, you may provide us with certain information related to you and your organization. This may include information that can be used to identify you, such as your name or contact information (collectively “Personal Information”). The Personal Information we obtain generally consists of (a) information you provide to us about yourself and others, (b) information we receive from other sources, and (c) automatically collected information.

  • Information You Provide to Us. When you use the Services, you may provide us with Personal Information relating to you and/or to individuals to whom you may provide or from whom you receive services. The Personal Information you provide to us may include, but is not limited to:

  • Driver’s license
  • Social security number
  • Tax identification number
  • Signature
  • Date of birth
  • Company information
  • Personal credit information (e.g., credit reports, credit scores)
  • Financial account information (e.g., bank account data obtained through financial data aggregation service providers)

  • Property-related data (e.g., automated valuations, property characteristics, title information)
  • Publicly available information (e.g., court records, liens, judgments, bankruptcies, UCC filings)
  • Inferences and risk scores (e.g., internal credit risk assessments generated by the Company’s underwriting model)
  • Information We Receive from Others. We may receive Personal Information about you from third-party sources and combine it with Personal Information we collect through the Services. These third-party sources include: identity verification and “Know Your Customer” (“KYC”) providers; credit reporting agencies (for both personal and business credit reports); data enrichment services; property data and valuation providers; financial data aggregation services; and AI and technology service providers. For example, we may obtain Personal Information from credit reporting agencies when we request a credit report in connection with your loan application, from data enrichment providers when we supplement your application information, from property data providers when we obtain property valuations, and from identity verification providers when we verify your identity.
  • Automatically Collected Information We automatically collect certain information about individuals who use the Services, such as information about computers, devices, and browsers used to access the Services. For example, we use cookies to improve your experience with the Services by remembering your login information. Third parties may also use cookies, pixels, or other devices to collect information when you use the Services. We do not control any cookies or other data collection tools that may be placed on the Services by a third party, and this Notice does not cover the use of such cookies and/or other data collection tools by any third party. We encourage you to read the privacy notices of such third parties to find out more about the information that may be collected by them and the choices you have regarding the collection, use, and sharing of such information. You may be able to “opt out” of placement of cookies through your web browser settings. However, by opting out, some portions of the Services may not function efficiently.
  • How We Use Your Information
  • Provide, Maintain, and Improve the Services. We may use your Personal Information to provide, maintain, and improve the Services, and to manage our relationship with you. In particular, we may use your Personal Information to:

  • Provide you with customer service or technical support
  • Send you confirmations, updates, security alerts, and support and administrative messages
  • Communicate with you about marketing or new features of the Services, including offers and promotions

  • Operate, protect, and optimize the Services and your experience, such as by performing analytics

  • Monitor and analyze usage and trends and otherwise measure the effectiveness of the Services

  • Maintain business records and comply with our legal and contractual obligations
  • Evaluate and underwrite loan applications
  • Verify your identity and prevent fraud
  • Conduct background checks, credit checks, and other due diligence
  • Comply with KYC, Bank Secrecy Act/Anti-Money Laundering (BSA/AML), and other regulatory requirements
  • Generate internal risk assessments and credit scores using automated systems, including artificial intelligence
  • Facilitate loan transactions with lending partners, brokers, and investors
  • Process loan payments and manage loan servicing
  • Improve the Company’s AI underwriting model and related technology
  • How We Provide Personal Information to Others. ‍We may provide the Personal Information we obtain:
  • With others as you allow or direct
  • With our service providers, vendors, and consultants who perform services on our behalf or who help us provide the Services, such as accounting, managerial, technical, marketing, or analytics services
  • To other parties as necessary or appropriate to comply with local, state, or federal laws, or to respond to a court order, judicial or other governmental subpoena or warrant, or in the event of bankruptcy proceedings
  • To other parties as necessary or appropriate to protect the rights, property, or safety of us, our users, our employees, copyright owners, third parties, or the public, including without limitation to protect us or our users from fraudulent, abusive, inappropriate, or unlawful use of the Services
  • To others in order to enforce or apply this Notice, our Terms of Use, or our other policies or agreements
  • In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition, or in any other situation where information may be disclosed or transferred as one of our business assets
  • With lending partners, investors, and brokers who may fund, participate in, or service your loan
  • With credit reporting agencies for credit checks and related reporting
  • With identity verification and KYC providers to verify your identity and prevent fraud
    • We use Plaid Inc. (“Plaid”) to gather your financial data from your financial institutions and to verify your identity. By submitting a loan application through the Services, you grant Navon Finance the right, power, and authority to act on your behalf to access and transmit your personal and financial information from your relevant financial institution. You acknowledge and agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with Plaid’s End User Privacy Policy.
  • With title companies and property data providers in connection with loan transactions
  • With AI and technology service providers that assist with underwriting and risk assessment
  • With data enrichment providers that supplement application information

Nothing herein restricts the using and sharing of de-identified, aggregated, or anonymized information, which may be used or shared with third parties without your consent.

  • How We Protect Your Information. We take measures designed to protect your Personal Information including to prevent loss, misuse, unauthorized access, disclosure, alteration, and destruction. Please be aware, however, that despite our efforts, no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other type of misuse. To protect the confidentiality of information maintained in your account, you must keep your password confidential and not disclose it to any other person. You are responsible for all uses of the Services by any person using your password. Please advise us immediately if you believe your password has been misused.
  • How We Retain Your Information. We retain your Personal Information for as long as necessary or appropriate to provide the Services you request and to fulfill legal compliance purposes and essential business purposes. The retention period for your Personal Information may vary depending on your use of the Services, our legal obligations, or other circumstances.
  • Age Restrictions. We do not knowingly collect, solicit, or maintain Personal Information from anyone under the age of 18 or knowingly allow such persons to use or register for the Services. If you are under 18, please do not send any Personal Information about yourself to us.
  • Your Choices and Opting Out. You may “opt out” of receiving marketing or promotional emails from us by following the instructions in those emails. If you opt out, we may still send you non-promotional emails, such as emails about your account or our ongoing business relations.
  • Do Not Track and Global Privacy Control. We do not currently take steps to respond to “Do Not Track” browser signals because no uniform standard to respond to such signals has been developed. We do, however, respond to the Global Privacy Control (“GPC”) to the extent required by applicable law, and allow eligible individuals to convey opt-out preferences when we detect the signal.   • Consumer Report Information. In connection with your loan application, we may obtain consumer reports (commonly known as credit reports) about you from one or more consumer reporting agencies. We may also obtain investigative consumer reports. Under the FCRA, you have the right to be informed if information in your consumer report has been used against you in connection with a credit decision. You also have the right to know what is in your file at a consumer reporting agency, to dispute incomplete or inaccurate information, and to have consumer reporting agencies correct or delete inaccurate, incomplete, or unverifiable information. If you are denied credit based in whole or in part on information in a consumer report, you will receive an adverse action notice identifying the consumer reporting agency that provided the report.
  • Automated Decision-Making and Artificial Intelligence. We use automated systems, including artificial intelligence (“AI”), as part of our loan underwriting and risk assessment process. These systems analyze the information described in this Notice to generate risk scores and credit assessments that factor into lending decisions. Automated processing is one component of our evaluation process, and human review is available. Depending on your state of residence, you may have the right to: (a) be informed that automated decision-making is being used; (b) receive a meaningful explanation of the logic involved; (c) opt out of decisions based solely on automated processing; and (d) request human review of an automated decision.   • Third-Party Websites, Apps, or Other Services. The Services may be made available to you through third-party platforms or services, or may contain links to websites, apps, or services not operated by us. Please note that we are not responsible for the privacy notices or practices of platforms or services not affiliated with us. We encourage you to read and familiarize yourself with the privacy policies and practices published by those third parties.
  • Changes and Updates to the Notice. We reserve the right to change the provisions of this Notice at any time. Please revisit this page periodically to stay aware of any changes. If we modify this Notice, we will make it available through the Services and indicate the date of the latest revision. Your continued use of the Services after the revised Notice has become effective indicates that you have read, understood, and agreed to the current version of this Notice.
