This Electronic Records and Signature Consent Agreement (“Consent”) applies to all interactions between you and Navon Finance LLC (“Navon,” “Company,” “we,” “us,” or “our”) relating to your use of our website, borrower portal, broker portal, loan application process, financing requests, loan servicing activities, and any related products or services (collectively, the “Services”).

Please read this Consent carefully and retain a copy for your records.

1. CONSENT TO ELECTRONIC RECORDS

By checking the applicable consent box, clicking “I Agree,” signing electronically, creating an account, submitting an application, or otherwise using the Services, you affirmatively consent to receive all records, disclosures, notices, agreements, communications, and other information relating to the Services in electronic form rather than in paper form. Your consent applies to all current and future interactions with Navon unless and until withdrawn in accordance with this Consent.

2. ELECTRONIC COMMUNICATIONS COVERED

Your consent includes, without limitation:

(a) loan applications;

(b) financing requests;

(c) prequalification notices;

(d) underwriting communications;

(e) requests for information or documentation;

(f) credit-related disclosures and notices;

(g) adverse action notices;

(h) privacy notices;

(i) terms of service;

(j) account agreements;

(k) servicing communications;

(l) payment reminders;

(m) account statements;

(n) payoff statements;

(o) modification agreements;

(p) electronic signatures;

(q) legally required disclosures; and

(r) all other records or communications relating to the Services.

These records may be delivered through email, borrower portals, websites, text messages containing links, electronic document platforms, or other electronic means permitted by law.

3. CONSENT TO USE ELECTRONIC SIGNATURES

You agree that your electronic signature has the same legal effect as a handwritten signature. You further agree that any electronic signature, click-through acceptance, digital acknowledgment, electronic authentication process, or other electronic indication of assent used by you in connection with the Services shall constitute your legally binding signature. You acknowledge and agree that electronic signatures may be used for agreements, disclosures, authorizations, certifications, applications, notices, amendments, and other documents relating to the Services.

4. PAPER COPIES

You may request a paper copy of any electronic record provided to you by contacting Navon at the contact information listed below. Navon reserves the right to charge a reasonable fee, to the extent permitted by law, for providing paper copies of previously delivered electronic records. Requesting a paper copy will not withdraw your consent to receive future records electronically.

5. WITHDRAWAL OF CONSENT

You may withdraw your consent to receive electronic records at any time by providing written notice to Navon. Your withdrawal of consent will become effective within a reasonable period after receipt and processing of your request. Withdrawal of consent may result in termination of your access to certain electronic Services, delay the processing of applications, limit available functionality, or otherwise affect Navon’s ability to provide Services. Any withdrawal of consent shall not affect the legal validity or enforceability of records provided or signed electronically before withdrawal becomes effective.

6. UPDATING CONTACT INFORMATION

You agree to maintain accurate and current contact information, including your email address, telephone number, and mailing address. You acknowledge that Navon may rely on the most recent contact information provided by you for delivery of electronic records. Failure to maintain accurate contact information may result in missed communications, disclosures, notices, or deadlines, for which Navon shall not be responsible.

7. HARDWARE AND SOFTWARE REQUIREMENTS

In order to access, receive, review, and retain electronic records, you must have:

(a) access to the internet;

(b) a current version of a web browser capable of supporting modern encryption and security protocols;

(c) an active and valid email account;

(d) software capable of opening PDF documents;

(e) a device capable of storing or printing electronic records; and

(f) sufficient storage capacity to retain electronic records.

Navon reserves the right to update these requirements as technology evolves. Any material changes will be communicated electronically.

8. CONFIRMATION OF ABILITY TO ACCESS ELECTRONIC RECORDS

By providing your consent, you represent and warrant that:

(a) you have access to the hardware and software requirements described above;

(b) you are able to receive electronic communications at the email address provided;

(c) you are able to access and review electronic records;

(d) you are able to retain electronic records by printing or saving them; and

(e) you have reviewed and understand this Consent.

9. FEDERAL E-SIGN ACT DISCLOSURE

This Consent is intended to comply with the Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq.) (“E-SIGN”), the Uniform Electronic Transactions Act (“UETA”), and other applicable electronic signature laws. You acknowledge that your consent is being provided electronically and that your electronic consent will be treated as valid and enforceable to the fullest extent permitted by law.

10. NO WAIVER OF OTHER RIGHTS

Nothing contained in this Consent limits any rights or obligations otherwise provided under applicable law, loan agreements, servicing agreements, privacy notices, or other agreements between you and Navon.
